Booking Terms
The terms that govern a YommySax booking — how a date is confirmed, what each party is responsible for, and how changes are handled.
Enquiry vs. confirmed booking
Submitting an enquiry through this website is a request for availability and a quote. It does not reserve your date and is not a confirmed booking.
A date is only held as a confirmed booking once we have provided written confirmation (for example, by email) and the deposit described below has been received. Until then, the date remains available to other clients.
Deposit and balance
A deposit is required to confirm and hold your date. The balance is then due before the event.
TODO(owner): confirm the deposit amount (for example, a percentage of the total fee).
TODO(owner): confirm when the balance is due (for example, a number of days before the event date).
Cancellation and refunds
If you need to cancel a confirmed booking, the deposit and any refund will be handled according to our cancellation policy, which generally reflects how far in advance you cancel and any costs already committed.
TODO(owner): confirm the cancellation and refund terms (for example, whether the deposit is non-refundable, and any sliding scale based on notice given).
Postponement and date changes
If you need to move your event to a different date, we will try to accommodate the change subject to our availability on the new date.
TODO(owner): confirm the postponement terms (for example, how deposits transfer to a new date, any time limit on rescheduling, and any difference in fee for peak dates).
Travel and accommodation
For events outside our usual area, and for national or international engagements, reasonable travel costs — and, where an overnight stay is needed, accommodation — are the client's responsibility and will be set out in your quote.
TODO(owner): confirm the travel and accommodation thresholds (for example, the distance beyond which travel is charged, the rate used, and the arrangements for flights and accommodation on out-of-area or international bookings).
Performance requirements
To perform safely and to a professional standard, we require the client/venue to provide: access to adequate mains electrical power at the performance position; a safe, stable and (for outdoor events) covered performance area that protects both performer and equipment from sun, rain and wind; and reasonable parking and load-in access near the performance area.
Where these requirements cannot be met, please tell us in advance so we can plan around them. We cannot be responsible for a reduced performance or for equipment damage caused by unsafe or unsuitable conditions outside our control.
Music licensing (SAMRO)
Live performances of music may require a performing-rights licence at the venue — in South Africa this is commonly a SAMRO licence held by the venue.
TODO(owner): confirm whether YommySax or the venue carries the SAMRO (or equivalent performing-rights) licence, and state it plainly here so clients know what, if anything, they need to arrange with their venue.
Recordings and publicity
We may wish to take photographs or short video at events for our own portfolio and social media, and clients sometimes ask to record the performance.
TODO(owner): confirm the recordings and publicity terms (for example, whether the client consents to us using event photos/video for promotion, and any limits on the client recording or broadcasting the performance).
Force majeure
Neither party is responsible for failing to perform due to events beyond its reasonable control — for example serious illness, accident, extreme weather, power failure, transport disruption, government restrictions or other emergencies.
If such an event prevents the performance, we will work with you in good faith to reschedule where possible, or to agree a fair resolution regarding any amounts paid.
Limitation of liability
TODO(attorney): draft and review a limitation-of-liability clause appropriate to this business and to South African law (and compatible with consumer-protection rules where they apply). As a placeholder, the intent is to limit our liability to the fee paid for the booking and to exclude indirect or consequential loss, without excluding any liability that cannot lawfully be excluded.
VAT and pricing
All fees are quoted in the currency stated in your quote.
TODO(owner): confirm whether prices include VAT, and whether YommySax is VAT-registered, so that quotes state clearly whether VAT is included, added, or not applicable.
Governing law
These terms are governed by the laws of the Republic of South Africa, and any dispute relating to a booking will be subject to South African law.
